Terms of Service
1. What Mend is, in one sentence
Mend is software you subscribe to that teaches you the federal credit-repair process and automates the tedious parts of disputing inaccurate items on your credit reports.
Mend is NOT a credit repair organization as defined by the Credit Repair Organizations Act (CROA), 15 U.S.C. §1679 et seq. We do not perform credit-repair services on your behalf. We do not contact credit bureaus, creditors, or collectors for you. We do not sign anything as you. You read every letter Mend drafts, you sign every letter, and you mail every letter yourself. You remain the legal sender of every communication.
2. Who we are
Mend (the "Service," "we," "us," or "our") is operated by [LEGAL ENTITY NAME], a [STATE] [LLC/Corporation], with a notice address of [BUSINESS ADDRESS]. You can reach us at hello@letmend.com.
3. Eligibility
To use Mend, you must be at least 18 years old, be a resident of the United States, and have the legal capacity to enter into a binding contract. By creating an account, you represent that you meet these requirements.
4. Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@letmend.com of any unauthorized use.
You may close your account at any time from your profile page. We may close your account if you violate these Terms or use the Service in a way that could expose us or other users to legal liability.
5. Subscription, billing, and auto-renewal
Mend is offered as a monthly subscription at $39.99 per month. All fees are billed in advance and are non-refundable except as described in our Refund Policy.
Auto-renewal notice:Your subscription automatically renews each month on the same calendar day until you cancel. By subscribing, you authorize us to charge your payment method on file at the start of each billing cycle. You will be notified by email at least 3 days before each renewal in jurisdictions that require advance notice (including California per Bus. & Prof. Code §17602 and New York per GBL §527-a).
Cancellation:You can cancel at any time, with no questions and no retention call, by clicking "Cancel subscription" on your profile page. Cancellation takes effect at the end of the current billing period. We do not require you to call, email, chat, or take any other action to cancel.
Price changes apply only to renewals after the change takes effect, with at least 30 days' advance email notice.
6. What your subscription includes (and does not)
Your subscription pays for access to Mend's software and educational content, including: AI audits of credit reports you upload or connect, AI-drafted dispute letters in your name, monitoring of credit reports through connected sources (where available), push and email alerts, the collections strategy tools, and educational guides. Your subscription does not pay for credit-repair services or results.
Mailing each letter requires you to print it, sign it, and pay for USPS Certified Mail with Return Receipt (typically ~$5 per letter). These postage costs are paid by you directly to USPS and are not included in your subscription.
7. No guarantees, no specific results
Mend does not guarantee any specific outcome.We do not promise any specific credit-score change, item deletion, or response from any bureau, creditor, or collector. Federal law (CROA, 15 U.S.C. §1679b(a)(3)) prohibits us from making such promises, and we don't. Individual results vary based on the accuracy of your reports, the documentation furnishers can produce, how diligently you mail and follow up on letters, and other factors outside our control.
Estimates Mend provides (such as "estimated point gain") are statistical projections based on typical outcomes, not promises. Treat them as educational only.
8. You stay the sender; we don't act for you
Mend is a tool. You are the actor. Specifically:
- You review every drafted letter before any action is taken.
- You print the letter, you sign it in your own hand, you place it in an envelope, you take it to USPS, and you pay for postage.
- You receive the bureau's response directly at your address.
- You decide whether to escalate to Round 2, Round 3, or stop.
Mend does not contact bureaus, creditors, or collectors on your behalf. Mend does not impersonate you in any communication. Mend does not have authority to settle, negotiate, or correspond with any third party for you. If you want a third party to act on your behalf, you need to hire one (typically a consumer-law attorney).
9. Mend is not legal advice
Mend provides educational content, automated audits, and template letter language. Mend is not a law firm, and Mend does not provide legal advice. Using Mend does not create an attorney-client relationship between you and Mend.
If you are being sued for a debt, have a complex identity theft situation, or need representation in any legal proceeding, consult a licensed attorney in your state. The National Association of Consumer Advocates (consumeradvocates.org) maintains a free directory of FCRA/FDCPA attorneys, most of whom take cases on contingency.
10. Your data and our use of it
See our Privacy Policy for full details on what we collect, how we use it, and your rights. In brief: we collect what you provide (uploaded reports, profile information, payment information), we use it to provide the Service, we never sell it, and we delete it within 30 days after you close your account (subject to legal retention requirements).
11. Acceptable use
You agree not to: (a) use Mend to dispute information you know to be accurate; (b) provide false personal information to us or to any third party in connection with the Service; (c) use Mend to harass, defraud, or harm anyone; (d) attempt to reverse-engineer, decompile, or extract source code from the Service; (e) use any automated means to access the Service except through our official API (if offered); (f) resell, sublicense, or rebrand the Service.
Disputing accurate information is a violation of the FCRA dispute process (§1681i(a)(3) — bureaus may dismiss such disputes as "frivolous") and may expose you to fraud liability. Mend is not responsible for consequences of misuse.
12. Intellectual property
Mend, the Mend wordmark, and all software, content, templates, and AI prompts are our intellectual property. We grant you a personal, non-transferable, non-exclusive license to use the Service for your own personal credit improvement during your active subscription.
The letters Mend drafts for you become yours once generated. You may use them however you like. You may not resell Mend-generated letters or templates to other consumers as a service.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MEND'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100. MEND IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY.
15. Indemnification
You agree to indemnify and hold Mend harmless from any claim arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
16. Dispute resolution and arbitration
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in [STATE OF INCORPORATION] or, at your election, by telephone or video.
Class action waiver: You and Mend agree to resolve disputes only on an individual basis. Neither you nor Mend may bring a claim as a plaintiff or class member in any purported class or representative proceeding.
30-day opt-out:You may opt out of this arbitration provision by emailing hello@letmend.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out."
17. Governing law
These Terms are governed by the laws of the State of [STATE OF INCORPORATION], without regard to conflict-of-laws principles.
18. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email and on this page at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
